These Terms & Conditions ("Terms") govern your access to and use of the BullSwipe website, mobile application, card services, and any related products or services (collectively, the "Services").

By accessing our website, creating an account, or using any BullSwipe Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree with these Terms, you must not access or use the Services.

1. About BullSwipe

BullSwipe provides technology solutions that enable eligible users to access card-based payment services supported by eligible digital assets through licensed issuing partners.

BullSwipe is not a bank and does not provide banking services, deposit accounts, or other regulated banking products.

The BullSwipe Card is issued by an authorized issuing partner and operates through the Visa payment network. The Card may be accepted wherever Visa is accepted, subject to merchant acceptance, network availability, applicable laws, eligibility requirements, and program restrictions.

References to Visa describe merchant acceptance only and do not imply sponsorship, endorsement, certification, or approval by Visa.

2. Definitions

Throughout these Terms:

Account means your registered BullSwipe user account.

Card means the BullSwipe credit card or virtual card issued by an authorized issuing partner.

Digital Assets means supported blockchain-based digital assets made available through the Services, as determined by BullSwipe from time to time.

Services means all products, software, applications, websites, payment services, and related functionality provided by BullSwipe.

User, you, or your refers to any individual accessing or using the Services.

3. Acceptance of these Terms

By using the Services, you confirm that:

  • you have read and understood these Terms;
  • you agree to comply with these Terms;
  • you accept any future amendments that become effective after publication.

BullSwipe may update these Terms from time to time to reflect changes in applicable laws, regulatory requirements, operational practices, or the Services.

Continued use of the Services after revised Terms become effective constitutes your acceptance of the updated Terms.

4. Eligibility

To use the Services, you must:

  • be at least eighteen (18) years of age;
  • have the legal capacity to enter into legally binding agreements;
  • complete all required identity verification procedures;
  • comply with all applicable laws and regulations.

BullSwipe may request additional information at any time to determine or maintain your eligibility.

BullSwipe reserves the right to refuse, suspend, or restrict access to the Services where permitted by law or required by regulatory obligations, compliance requirements, or issuing partner policies.

Access to the Services is always subject to eligibility requirements.

5. Account Registration

To access certain Services, you must create a BullSwipe account.

When registering, you agree to:

  • provide complete, accurate, and current information;
  • keep your information updated;
  • maintain the confidentiality and security of your login credentials;
  • notify BullSwipe immediately if you believe your account has been accessed without authorization.

You remain responsible for all activities conducted through your account unless otherwise required by applicable law.

6. Identity Verification

BullSwipe is committed to complying with applicable legal and regulatory requirements.

Before certain Services become available, users may be required to complete identity verification procedures, including:

  • Know Your Customer (KYC) verification;
  • Anti-Money Laundering (AML) screening;
  • sanctions screening;
  • fraud prevention and security checks.

BullSwipe may request additional information or documentation at any time and may conduct ongoing compliance reviews throughout your relationship with the Services.

Failure to complete required verification procedures may result in delayed, restricted, suspended, or terminated access to the Services.

Completion of identity verification does not guarantee approval, continued eligibility, or access to any specific Service.

7. Description of Services

BullSwipe provides eligible users with access to various financial technology services, including:

  • virtual payment cards;
  • physical cards, where available;
  • card-based payment solutions supported by eligible Digital Assets;
  • payment management tools;
  • transaction history;
  • account management functionality.

Available features may vary depending on jurisdiction, eligibility, regulatory requirements, issuing partner policies, and product availability.

BullSwipe may modify, suspend, discontinue, or introduce Services at any time where permitted by applicable law.

8. Card Services

Card services are provided through licensed issuing partners.

BullSwipe provides technology and platform services but is not the issuer of the Card.

Certain rights and obligations relating to the Card may also be governed by the issuing partner's terms and conditions.

The Card may be used for lawful purchases at participating merchants that accept Visa, subject to applicable laws, merchant acceptance, eligibility requirements, network availability, and program rules.

BullSwipe does not guarantee that every Visa-accepting merchant will approve every transaction.

Transactions may be subject to:

  • fraud prevention measures;
  • compliance reviews;
  • security controls;
  • network availability;
  • merchant acceptance;
  • applicable spending limits;
  • regulatory requirements.

Transaction approval is not guaranteed.

9. Digital Assets

Certain Services allow supported Digital Assets to be used in connection with eligible card transactions.

BullSwipe may add, remove, or modify supported Digital Assets at its sole discretion and without prior notice where permitted by law.

Digital Assets, including stablecoins, may involve operational, technological, regulatory, and market risks.

Users remain solely responsible for understanding and accepting the risks associated with holding Digital Assets, including potential fluctuations in value.

10. Risk Disclosure

Digital Assets involve financial risk.

Their value may increase or decrease significantly over time.

Past performance does not guarantee future performance.

BullSwipe does not provide:

  • investment advice;
  • financial advice;
  • tax advice;
  • legal advice.

Nothing contained within the Services, website, application, or marketing materials constitutes a recommendation to purchase, sell, hold, or otherwise transact in any Digital Asset.

Users remain solely responsible for determining whether the Services are appropriate for their personal financial circumstances and should seek independent professional advice where appropriate.

11. Availability

BullSwipe Services may not be available in every jurisdiction.

Access to the Services depends on applicable laws, regulatory requirements, issuing partner policies, product availability, and individual eligibility.

Use of the Card remains subject to the applicable terms and conditions of the issuing partner.

The Card may be accepted wherever Visa is accepted, subject to merchant acceptance, network availability, applicable laws, eligibility requirements, and program rules.

BullSwipe does not guarantee merchant acceptance, transaction approval, uninterrupted availability of the Services, or continued eligibility.

12. Using Your Card

The BullSwipe Card may be used for lawful purchases at participating merchants that accept Visa, subject to applicable laws, merchant acceptance, eligibility requirements, network availability, and program rules.

You agree not to use the Card for:

  • unlawful or fraudulent activities;
  • transactions prohibited by applicable laws or regulations;
  • sanctioned persons, entities, or jurisdictions;
  • activities that violate these Terms or the requirements of the issuing partner;
  • any activity that may expose BullSwipe, its partners, or the payment network to legal, regulatory, or reputational risk.

BullSwipe reserves the right to decline, suspend, restrict, or terminate Card usage where required for security, fraud prevention, regulatory compliance, or operational reasons.

13. Transaction Processing

When an eligible Card transaction is authorized, supported Digital Assets may be used within the BullSwipe platform to facilitate settlement of the transaction in accordance with the applicable card program.

Merchants receive payment through the Visa payment network.

Merchants do not receive Digital Assets directly.

Transaction processing times may vary depending on:

  • blockchain network conditions;
  • payment network availability;
  • compliance or security reviews;
  • fraud prevention measures;
  • operational requirements.

BullSwipe does not guarantee uninterrupted transaction processing or transaction approval.

14. Merchant Acceptance

The BullSwipe Card may be accepted at participating merchants that accept Visa.

Merchant acceptance is determined solely by the merchant and the applicable payment network.

BullSwipe does not control merchant acceptance policies and cannot guarantee that every transaction or merchant will accept the Card.

Certain merchants, industries, products, services, or jurisdictions may restrict or decline transactions in accordance with their own policies or applicable laws.

15. Fees

Certain Services may be subject to applicable fees and charges.

These may include, where applicable:

  • physical card issuance fees;
  • replacement card fees;
  • foreign exchange fees;
  • transaction-related fees;
  • other service fees disclosed by BullSwipe or the issuing partner.

Where required by applicable law, fees will be disclosed before they become payable.

Unless expressly stated otherwise, all Services remain subject to applicable fees, limits, and eligibility requirements.

Promotional offers do not eliminate fees that may otherwise apply.

16. Spending Limits

Use of the Card may be subject to transaction limits established by BullSwipe, the issuing partner, regulatory authorities, or the applicable card program.

These limits may include:

  • daily transaction limits;
  • monthly transaction limits;
  • annual transaction limits;
  • maximum transaction amounts;
  • compliance or security restrictions.

BullSwipe may modify spending limits at any time where necessary for operational, regulatory, fraud prevention, or security purposes.

17. Promotional Offers

BullSwipe may periodically make promotional campaigns available to eligible users.

Participation in any promotion is voluntary and subject to:

  • eligibility requirements;
  • successful identity verification;
  • applicable laws and regulations;
  • campaign-specific terms and conditions;
  • promotional availability.

Promotional campaigns may include, where applicable:

  • a Free Virtual Card;
  • welcome rewards;
  • cashback promotions;
  • limited-time promotional offers.

Promotions are available for a limited period only and while promotional allocations remain available.

BullSwipe reserves the right to modify, suspend, replace, or withdraw any promotion at any time where permitted by applicable law.

Nothing in these Terms guarantees the availability of any promotional offer.

18. Welcome Reward

From time to time, eligible new users may qualify for a promotional welcome reward after completing all applicable registration and verification requirements.

Where a promotional campaign is active, eligible users may receive:

  • a promotional reward of 10 USDT; and
  • rewards distributed from a promotional allocation of up to 10,000 USDT, subject to campaign availability.

Eligibility is determined at BullSwipe's sole discretion and depends upon:

  • successful account registration;
  • completion of required identity verification;
  • compliance screening;
  • fraud prevention checks;
  • satisfaction of all applicable promotional terms.

Rewards are limited, subject to availability, and are not guaranteed.

19. Cashback Promotion

BullSwipe may offer promotional cashback campaigns for eligible users.

Where applicable, an active promotional campaign may include either:

  • 2% cashback for three (3) months, with promotional rewards capped at USD 2,500; or
  • 2.5% cashback for three (3) months, with promotional rewards capped at USD 2,000,

depending on the applicable promotional campaign.

Participation requires, at a minimum:

  • successful account registration;
  • completion of identity verification;
  • a qualifying Card transaction of at least USD 25;
  • continued compliance with these Terms and all applicable campaign conditions.

Cashback is promotional in nature, subject to campaign availability, eligibility requirements, applicable laws, and specific promotional terms.

BullSwipe reserves the right to amend, suspend, or terminate any cashback campaign where permitted by applicable law.

20. Free Virtual Card

From time to time, eligible users may receive one Virtual Card without an issuance fee as part of an active promotional campaign.

Eligibility remains subject to:

  • successful identity verification;
  • applicable eligibility requirements;
  • promotional availability;
  • issuing partner requirements;
  • applicable program rules.

Availability of a Free Virtual Card is not guaranteed and may be modified or withdrawn without prior notice where permitted by applicable law.

21. Changes to Promotions

BullSwipe reserves the right to:

  • modify promotional terms;
  • suspend or discontinue promotional campaigns;
  • adjust eligibility requirements;
  • correct pricing, typographical, technical, or promotional errors;
  • withdraw promotional offers where necessary.

Changes may become effective immediately where permitted by applicable law.

Promotional offers do not create any contractual right to future rewards or continued availability.

22. Taxes

You are solely responsible for determining, reporting, and paying any taxes that may arise from your use of the Services, including, where applicable, Digital Asset transactions, promotional rewards, cashback, or other benefits received through BullSwipe.

BullSwipe does not provide tax advice and recommends that you consult an independent tax professional regarding your individual circumstances.

23. User Responsibilities

By using the Services, you agree to:

  • provide accurate, complete, and up-to-date information at all times;
  • maintain the confidentiality and security of your account credentials;
  • use the Services only for lawful purposes and in accordance with these Terms;
  • comply with all applicable laws, regulations, and regulatory requirements;
  • promptly notify BullSwipe if you suspect unauthorized access to your account or any security incident.

You are responsible for all activities conducted through your account unless otherwise required by applicable law.

24. Prohibited Activities

You must not use the Services for any unlawful, fraudulent, or prohibited purpose, including but not limited to:

  • money laundering or terrorist financing;
  • fraud, deception, or misrepresentation;
  • transactions involving sanctioned persons, entities, or jurisdictions;
  • attempts to gain unauthorized access to BullSwipe systems or data;
  • introducing malware, viruses, or other harmful software;
  • infringing the intellectual property rights of BullSwipe or third parties;
  • using the Services in violation of applicable laws, regulations, or payment network rules;
  • any activity that may expose BullSwipe, its issuing partners, or the Visa payment network to legal, regulatory, operational, or reputational risk.

BullSwipe reserves the right to investigate suspected violations and to take any action it considers appropriate, including restricting, suspending, or terminating access to the Services where permitted by applicable law.

25. Security

BullSwipe implements reasonable administrative, technical, and organizational safeguards designed to help protect user accounts, personal information, and the integrity of the Services.

Users are responsible for:

  • maintaining secure passwords and login credentials;
  • enabling available security features where applicable;
  • protecting the devices used to access the Services;
  • regularly monitoring account activity.

BullSwipe may temporarily suspend or restrict access to the Services where reasonably necessary to protect users, investigate suspected unauthorized activity, comply with legal obligations, or maintain platform security.

While BullSwipe applies appropriate security measures, no technology system can guarantee absolute security.

26. Fraud Prevention

BullSwipe maintains fraud prevention, security monitoring, and compliance procedures designed to protect users, issuing partners, and the integrity of the Services.

Transactions may be monitored and, where appropriate, delayed, declined, restricted, or subject to additional review.

BullSwipe may request additional information or documentation before authorizing or completing certain transactions where required for security, regulatory, or operational purposes.

Completion of additional reviews does not guarantee transaction approval.

27. Suspension or Termination

BullSwipe may suspend, restrict, or terminate access to all or part of the Services where reasonably necessary, including where:

  • required by applicable law or regulatory authorities;
  • fraudulent, suspicious, or unauthorized activity is identified;
  • identity verification or compliance requir ements are not satisfied;
  • these Terms are breached;
  • continued access presents a legal, regulatory, operational, or security risk;
  • required by an issuing partner or payment network.

Where permitted by applicable law, BullSwipe may provide prior notice before suspension or termination.

Suspension or termination of the Services does not affect any rights or obligations that arose before the effective date of such action.

28. Service Availability

BullSwipe seeks to maintain reliable access to the Services but does not guarantee uninterrupted, continuous, or error-free availability.

The Services may be unavailable from time to time due to, including but not limited to:

  • scheduled maintenance;
  • software upgrades;
  • payment network interruptions;
  • blockchain network conditions;
  • third-party service provider interruptions;
  • events beyond BullSwipe's reasonable control.

BullSwipe is not liable for temporary interruptions, delays, or unavailability resulting from such circumstances except where required by applicable law.

29. Third-Party Services

Certain Services depend on third-party providers, including but not limited to:

  • card issuing partners;
  • payment networks;
  • identity verification providers;
  • blockchain infrastructure providers;
  • technology service providers.

BullSwipe is not responsible for products or services provided directly by third parties.

Your use of third-party services may also be governed by the applicable third party's own terms, policies, and legal agreements.

30. Intellectual Property

All intellectual property rights relating to the Services, including but not limited to:

  • trademarks;
  • service marks;
  • logos;
  • graphics;
  • software;
  • website content;
  • mobile application content;
  • text;
  • designs;
  • technology;

remain the exclusive property of BullSwipe or its licensors.

Nothing contained in these Terms transfers ownership of any intellectual property rights to you.

You may not reproduce, distribute, modify, publish, reverse engineer, or commercially exploit any BullSwipe content without prior written authorization, except as permitted by applicable law.

31. Privacy

BullSwipe processes personal information in accordance with its Privacy Policy.

By using the Services, you acknowledge that BullSwipe may collect, use, process, store, and disclose personal information where necessary for purposes including:

  • account administration;
  • identity verification;
  • fraud prevention;
  • regulatory compliance;
  • customer support;
  • security monitoring;
  • service improvement.

32. Communications

By creating an account or using the Services, you consent to receive communications relating to:

You may unsubscribe from marketing communications at any time by following the instructions included in those communications.

Operational, security, regulatory, and legally required communications may continue to be sent while you maintain an active account or where otherwise required by applicable law.

33. Disclaimer

The Services are provided on an "as available" and "as is" basis, subject to applicable law.

While BullSwipe makes reasonable efforts to provide reliable Services, BullSwipe does not warrant or guarantee that:

  • the Services will always be available;
  • the Services will operate without interruption or error;
  • every transaction will be approved or completed;
  • every feature will remain available at all times;
  • the Services will meet every user's individual expectations or requirements.

Availability and functionality may depend on operational, regulatory, technical, security, payment network, blockchain, or third-party factors beyond BullSwipe's reasonable control.

34. No Financial, Investment or Tax Advice

The information made available through the Services is provided for general informational purposes only.

BullSwipe does not provide:

  • financial advice;
  • investment advice;
  • legal advice;
  • accounting advice;
  • tax advice.

Nothing contained within the Services, website, mobile application, marketing materials, or customer communications constitutes a recommendation or solicitation to purchase, sell, hold, or otherwise transact in any Digital Asset.

Users remain solely responsible for making their own financial decisions and should seek independent professional advice where appropriate.

35. Limitation of Liability

To the maximum extent permitted by applicable law, BullSwipe shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or similar damages, including any loss of profits, revenue, business opportunity, goodwill, data, or anticipated savings arising out of or relating to:

  • your use of, or inability to use, the Services;
  • delayed, declined, or failed transactions;
  • merchant decisions;
  • payment network interruptions;
  • blockchain network conditions;
  • Digital Asset price fluctuations;
  • actions or omissions of third-party service providers;
  • unauthorized access not resulting from BullSwipe's gross negligence or willful misconduct;
  • events beyond BullSwipe's reasonable control.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

36. Indemnification

You agree to indemnify, defend, and hold harmless BullSwipe, its affiliates, directors, officers, employees, contractors, licensors, issuing partners, service providers, and agents from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from or relating to:

  • your breach of these Terms;
  • your misuse of the Services;
  • your violation of applicable laws or regulations;
  • your infringement of the rights of any third party;
  • any fraudulent, unlawful, or unauthorized activity carried out through your account.

This indemnification obligation survives termination of these Terms to the extent permitted by applicable law.

37. Compliance with Laws

You are solely responsible for ensuring that your access to and use of the Services complies with all laws and regulations applicable to you.

BullSwipe may suspend, restrict, decline, or terminate access to the Services where necessary to comply with:

  • applicable laws;
  • regulatory requirements;
  • court orders;
  • payment network rules;
  • issuing partner requirements;
  • sanctions or compliance obligations.

38. Force Majeure

BullSwipe shall not be liable for any delay, interruption, or failure to perform its obligations where such delay or failure results from events beyond its reasonable control, including but not limited to:

  • natural disasters;
  • acts of God;
  • war or armed conflict;
  • terrorism;
  • civil unrest;
  • government actions;
  • changes in applicable laws or regulations;
  • internet or telecommunications failures;
  • payment network interruptions;
  • blockchain network disruptions;
  • cyberattacks;
  • labour disputes;
  • power outages;
  • failures of third-party service providers.

BullSwipe will make reasonable efforts to resume normal operations as soon as practicable.

39. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws applicable to the BullSwipe contracting entity, unless otherwise required by mandatory consumer protection laws.

Any dispute arising out of or relating to these Terms or the Services shall be submitted to the competent courts having jurisdiction over the relevant BullSwipe contracting entity, unless otherwise required by applicable law.

40. Changes to These Terms

BullSwipe may amend or update these Terms from time to time to reflect changes in the Services, legal requirements, regulatory obligations, or operational practices.

The most current version will be published on the BullSwipe website together with the updated Effective Date.

Your continued use of the Services after revised Terms become effective constitutes your acceptance of those updated Terms.

41. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court or competent authority, that provision shall be enforced to the maximum extent permitted by law.

The remaining provisions shall remain valid, enforceable, and continue in full force and effect.

42. Entire Agreement

These Terms, together with the Privacy Policy, Promotional Terms, and any additional policies or legal notices expressly incorporated by reference, constitute the entire agreement between you and BullSwipe regarding your use of the Services.

They supersede all prior agreements, communications, representations, and understandings relating to the Services.
